Puzzling Cancellation of Rubik’s Cube Trademark

The European General Court has confirmed the cancellation of the tri-dimensional trademark granted to the Rubik’s Cube. The mark was first cancelled in 2017 by the EU’s Intellectual Property Office (EUIPO). One of the arguments was that signs consisting exclusively of the shape of goods which is necessary to obtain a technical result cannot be registered under trademark law. The mark still remains however valid in the United States although it is likely this cancellation will spill over at to attempt cancellation of the US registration. More to come on this IP puzzle!
